Terms & Conditions
Terms governing MAL physician-support services supplied by Care Links Sweden AB under the MAL Sverige™ brand.
1. Contracting Parties and Scope
These general terms apply when Care Links Sweden AB, Swedish company registration number 559292-8633, operating under the MAL Sverige™ brand (the “Provider”), supplies contracted physician support to a clinic or other business customer (the “Client”). These are business-to-business terms and not consumer terms. In the event of inconsistency, the individually signed agreement, service schedule and any applicable data processing agreement take precedence. These website terms alone do not establish a medical services engagement.
2. Scope of Services
MAL Sverige™ provides specialist physician-led support to aesthetic clinics within the selected package and the scope agreed in writing. Depending on the package, services may include prescription support, individual patient-specific medication orders, medical advice, complication support and quality-management system assistance. “Medicinskt ansvarig läkare” (MAL) is used here as an industry description of contracted physician support; it does not establish a universally required statutory office under that title. The service does not replace the legal duties of the healthcare provider, clinic manager or treating professionals.
3. Packages and Prices
MAL BASIC: SEK 1,250 per month excluding VAT. Includes contracted prescription support and a 5% training discount. Individual medication orders and medical consultation are not included.
MAL STANDARD: SEK 3,000 per month excluding VAT. Includes prescription support, up to 15 individual orders per month, medical advice and complication support, and a 10% training discount.
MAL PREMIUM: SEK 5,000 per month excluding VAT. Includes prescription support, up to 30 individual orders per month, medical advice, complication support, quality-management system assistance and a 10% training discount.
For STANDARD and PREMIUM, orders above the included volume cost SEK 250 per order excluding VAT unless expressly agreed otherwise. All prices exclude VAT, which is added under applicable tax rules. The precise definition of a chargeable order and any additional services must be stated in the individual agreement.
4. Applications, Verification and Contract Formation
Submitting a website application is an enquiry and does not automatically grant approval, access to services or entitlement to a medication order. The Provider may request relevant information about professional licences, authorisation, IVO registration, patient insurance, operations and treatments. The Provider may decline an application where medical, legal or organisational conditions are not met. An agreement becomes binding only when both parties have signed and any expressly stated commencement conditions have been satisfied.
5. Clinical Assessment and Prescribing
Every medication order and prescription requires an individual medical assessment, sufficient clinical information and an appropriately authorised prescriber. The Provider does not guarantee that a requested order or prescription will be issued. Automatic or blanket orders without the required assessment are not provided. The Client remains responsible for patient identification, relevant clinical information, informed consent, patient records, treatment delivery and follow-up within its own practice. Clinical decisions remain the responsibility of the authorised professional making them.
6. Client Responsibilities
The Client is responsible for required registrations, insurance, authorised personnel, local procedures, appropriate equipment and a functioning quality-management system under applicable rules. The Client must provide accurate, current information, promptly report material changes and use the agreed secure communication channels. A training certificate or MAL agreement does not itself expand anyone’s legal authority to treat patients or prescribe medicines.
7. Medical Advice, Complications and Emergencies
Medical advice and complication support are included only to the extent stated in the selected package and agreement. Response times, availability, communication channels and limitations must be defined in the service schedule. The service is not an emergency department and does not provide 24-hour on-call coverage unless expressly agreed. For emergencies or potentially serious conditions, the clinic must immediately follow its emergency procedures and contact 112 or emergency healthcare when necessary.
8. Quality-Management Systems and Templates
Where PREMIUM includes quality-management assistance, the materials support the Client’s own quality assurance activities. Documents, templates and procedures must be reviewed, adapted, approved, implemented and monitored within the individual clinic. Provider materials do not replace the Client’s statutory quality-management obligations. The agreement specifies the deliverables, format and permitted use of materials.
9. Invoicing and Payment
Fees are invoiced in accordance with the billing period, due date and payment method specified in the signed agreement. Late-payment interest and statutory recovery charges may apply where legally permitted and contractually applicable. The Client must dispute an allegedly incorrect invoice in writing without unreasonable delay and explain the grounds. Following written notice and a reasonable opportunity to remedy non-payment, non-emergency contractual services may be suspended to the extent consistent with patient safety and applicable law.
10. Minimum Term and Termination
MAL BASIC: no minimum commitment, but three months’ notice under the agreement.
MAL STANDARD and MAL PREMIUM: an initial six-month minimum term followed by three months’ notice under the agreement.
Termination must be sent in writing to info@nordicskinklinik.se and acknowledged by the recipient. The agreement must specify when notice starts, how termination during the minimum term operates and the effective end date. On termination, the parties must plan a patient-safe handover of ongoing matters and handle records according to law and contract.
11. Breach and Early Termination
A party may require remedy of a material breach. If the breach is not remedied within a reasonable time following written notice, early termination may be available under the agreement and applicable law. The Provider may immediately decline a specific clinical action if it cannot be performed safely or lawfully. This does not displace patient-safety duties or liability for actions already taken.
12. Confidentiality and Personal Data
The parties must protect confidential business information and personal data using appropriate confidentiality and security measures. The website privacy policy is available at https://www.malsverige.se/integritetspolicy/. For patient data and other information processed during an ongoing medical engagement, the parties’ data-protection roles, legal bases, secure transfer methods and any necessary processing agreements must be determined separately based on actual processing. Patient data must not be submitted through ordinary website forms.
13. Liability
Each party is responsible for its own acts, omissions and statutory and contractual obligations. Nothing in these terms limits liability that cannot lawfully be limited, including mandatory patient-safety responsibilities. Any specific business-to-business liability limitation must be agreed in writing, reasonable and consistent with mandatory law. The Provider does not guarantee any particular clinical or commercial outcome.
14. Amendments and Governing Law
Changes to service scope, pricing or other material contractual terms require authority under the individual agreement or a separate agreement. Updating this website page does not automatically amend an existing signed contract. Swedish law applies. The parties should first seek to resolve disputes by negotiation; failing that, disputes are decided by a competent Swedish court unless otherwise validly agreed.
